the terms

these terms are the agreement between you and mien whenever you use bemien.com: browsing the feed, saving, posting, connecting, or buying. by using mien you agree to them. if you do not agree, please do not use mien.

1. who we are

mien is run by Mien Market LLC, a Delaware limited liability company ("mien", "we", "us"). mien is a place to find clothes and the pictures that make you want them: a feed of pieces, fits and channels, put together by the people and brands on it.

2. using mien

you need to be at least 13 to use mien, and at least 18 (or the age of majority where you live) to buy anything. if you are under 18, a parent or guardian has to agree to these terms for you.

you can browse mien without an account. saving, posting, connecting, following and some purchases need one.

3. your account

give us a real email address and keep your sign-in to yourself. you are responsible for what happens on your account.
your handle cannot pretend to be someone else, a brand you do not run, or mien.
tell us at info@bemien.com if you think someone else got into your account.
you can delete your account at any time from your account settings or by emailing us.

4. what you post

you keep ownership of the pictures, links, notes and channels you post. by posting them you give mien a worldwide, non-exclusive, royalty-free licence to host, store, copy, resize, crop, display, and share them on mien and in mien's own promotion of mien (for example a post on mien's social accounts showing what is on the feed), and to let other members save and connect them into their channels. this licence ends when you delete the post or your account, except for copies other members already connected, backups we keep for a limited time, and anything we have to keep by law.

when you post, you are telling us that:

you took the picture, or you have the right to post it, or it is a link to a page that is already public;
anyone recognisable in it is fine with it being posted;
it does not break these terms or the law.

we may describe what is in a picture (for example tagging the pieces in a fit and linking to where they are sold) and rank, resize or crop it so the feed works.

5. the screen and takedowns

every post goes through an automatic screen before anyone else sees it. most posts go live in moments. a post can be held back, refused, or removed, and posts that break the rules on sexual content, minors, violence, hate or self-harm are deleted outright and count as a strike against the account. too many strikes and an account is paused or closed. the screen is automated and will sometimes get it wrong: if you think it did, email us and a person will look.

anyone can report a post. if something on mien is yours and was posted without your permission, use the takedown page or email info@bemien.com with: what the work is, a link to the post, how to reach you, and a statement that you believe in good faith the use is not authorised and that your notice is accurate. we take down what we are asked to in good faith, tell the person who posted it, and close the accounts of people who repeatedly post work that is not theirs.

6. what is not allowed

sexual or explicit content, and anything sexualising a minor, ever;
violence, gore, hate, harassment, threats, or anything encouraging self-harm;
someone else's work, photos or likeness without their permission;
counterfeits, fakes sold as real, or anything illegal to sell;
spam, fake engagement, misleading links, or posting the same thing over and over;
scraping, crawling or copying mien in bulk, getting around a limit or a ban, or interfering with how mien runs;
using mien to break the law.

7. bots on mien

some accounts on mien are run by mien itself, automatically, to keep the feed full of good finds. they are marked as bots wherever they appear. what they post comes from public pages and brands' own stores, and it goes through the same screen as everything else. a bot never pretends to be a person.

8. buying

pieces on mien are sold in one of two ways, and each tile says which:

buy on mien: you check out on mien. the brand ships the order to you. your order is covered by our store terms, shipping policy and refund policy, which also apply as part of these terms.
buy from brand: the link takes you to the brand's own site, and the sale is between you and that brand, on its terms. mien may earn a commission when you buy this way, at no extra cost to you; see the disclosure. we do our best to keep prices and stock right, but the brand's site is what counts.

prices are shown in the currency on the tile. a price, picture or description can be wrong; if it is, we can cancel an order before it ships and refund you in full.

9. mien's stuff

the mien name, mark, site design and code belong to Mien Market LLC. brand names and logos belong to their brands and appear on mien to say whose piece something is, not that the brand endorses mien unless it says so. you may share links to anything on mien; please do not copy the site itself.

10. ending things

you can stop using mien and delete your account at any time. we can pause or close an account, or remove anything on it, if it breaks these terms, puts other people or mien at risk, or if the law requires it. where it makes sense we will tell you why. sections 4 (for copies already connected), 9, 11 and 12 keep applying after an account is closed.

11. the legal part

as is. mien is provided as is and as available. we do not promise it will always be up, error free, or that everything posted on it is accurate. we are not responsible for what members post or for the sites and brands mien links to.

limits. to the extent the law allows, mien is not liable for indirect, incidental, special or consequential losses, or for lost profits or data, and our total liability to you for any claim about mien is limited to the greater of what you paid mien in the twelve months before the claim or 100 US dollars. nothing here limits rights you have under consumer law that cannot be limited.

your part. if something you post or do on mien breaks these terms or someone's rights and leads to a claim against mien, you agree to cover mien's reasonable costs of that claim.

disputes. if something goes wrong, email us first and we will try to sort it out within 30 days. these terms are governed by the laws of the State of Delaware, without regard to its conflict of law rules, and any dispute that cannot be settled goes to the state or federal courts in Delaware, unless the law where you live gives you the right to bring it at home.

changes. we may update these terms as mien changes. the date below shows when they last changed, and for a significant change we will say so on the site or by email before it applies. using mien after a change means you accept the new terms.

the rest. if any part of these terms cannot be enforced, the rest still applies. not enforcing something right away does not mean we give it up. these terms, together with the store policies linked above, are the whole agreement between you and mien about using mien.
